Terms and Waiver and Release of Liability and Indemnity Agreement

By responding “ACCEPT” or “YES,” the individual, individuals, entity, or entities (“User(s)”) referring or responding to the associated automated SMS program (“Program”) agree to all terms in this Agreement (“Agreement”). This agreement is formed between the User(s) and Epharmix, Inc. D/B/A CareSignal (“CareSignal”).

User(s) CERTIFY that they are over 18 years of age.

User(s) CERTIFY that they understand that the Program is not a medical device and is not a replacement for medical evaluation or care. User(s) CERTIFY that they understand that the Program is not a replacement for urgent care or 911, and they understand that no medical evaluation or referral will be made.

User(s) understand that they are sharing health information over non-encrypted SMS, and that this information may be used by CareSignal for business purposes.

User(s) understand that this program does not provide, and is not to be relied on for, medical or health guidance. User(s) understand this is not an emergency alert system.

User(s) furthermore UNCONDITIONALLY AGREE TO WAIVE, RELEASE, DISCHARGE, AND CONVENANT NOT TO SUE CareSignal, and/or any of the aforementioned’s officers, employees, agents, or volunteers (combined “Associates”) from any and all claims and causes of action, whether in law or equity, that User(s) may have for any LIABILITY, LOSS, DAMAGE, or INJURY, including liability for personal injury or death arising out of, related to, or in connection with the Program, whether caused or claimed to be caused by the active or passive negligent actions or omissions of CareSignal or Associates.

User(s) AGREE TO DEFEND, INDEMNIFY, AND HOLD HARMLESS CareSignal and Associates from and against any and all liability, including but not limited to claims asserted, demands, causes of action, costs, expenses, losses, attorney fees, injuries, or payments for injury to any person or property, including injury to the User(s). Also covered is liability arising from, connected with, caused by, or claimed to be caused by, the active or passive negligent acts or omissions of CareSignal or Associates that may be in combination with the active or passive negligent acts or omissions of the User(s) or any third party.

User(s) understand that this Agreement and the Terms may change at any time, with no notice provided. User(s) understand that the contents, logic, or other attributes of the Program may change at any time, with no notice provided. User(s) agree that if any terms of this Agreement are determined to be invalid, the remainder of the agreement will remain valid.

User(s) certify that they have read this agreement, understand its contents, and by responding “ACCEPT” or “YES” User(s) further agree that no oral representations, statements, or agreements apart from this written Agreement have been relied upon.

 

SMS Terms

 

Call to Action

Text HEALTH to the shortcode 67634 to join CareSignal’s COVID Companion. Message and data rates may apply. Recurring Messages. The keyword CTA will be provided verbally (in person or over the phone), via flyers, or QR codes in relevant locations.

Double Opt-in

Upon receiving the keyword sent by the end user, CareSignal will send the end user an introduction message along with a prompt to confirm the opt-in. The end user will need to accept the opt-in via SMS before the rest of the CareSignal communications start.

STOP Information

End users can text STOP to 67634 to stop receiving CareSignal communications at any time. Message and data rates may apply. They may text back the appropriate keyword to restart the conversation flow after STOP.

HELP Information

For additional information, end user can text HELP to 67634, or call 1-866-839-5903, or contact support@caresignal.health. Message and data rates may apply. For emergencies, end users are instructed to call 911.

Message Frequency

After the initial conversation flow post opt-in, the end user can choose to opt into educational messages in the subsequent days. Message Frequency Varies.

Carrier Liability

The wireless carrier does not guarantee that messages will be delivered and will not be liable for delayed or undelivered messages.
